The Court of Queen’s Bench has announced that for matters where all parties are represented by Counsel, applications that would otherwise be heard on notice in Justice Chambers, including special applications, can now be submitted by desk application with written argument. This includes Master’s Appeals, Appeals from the Provincial Court, Minor’s Property Settlements, but does not include contempt applications.
The consent of all parties is required to proceed in this manner, and each application will be considered by the Court for suitability. If the Justice determines the matter is not appropriate for a desk application, the Court may direct the parties to scheduling a hearing.
The Minister of Justice has also announced that the Ministerial Order suspending limitation periods to June 1, 2020, will not be renewed. All limitations and time periods affected by the Order will resume to run on June 1, 2020.
